JAY HIGHLEY’S DRIVING SCHOOL TERMS AND CONDITIONS  

Introduction offer – The introduction offers of £139 for the first four hours, (two 2hr lessons) is only available for brand new learners. If it is discovered that you are not new to learning to drive you will lose the introduction offer and will be charged at the higher rate. 
 
Special offers – I reserve the right to introduce and withdraw special offers at any time. These terms and conditions are still valid with all special offers. 
 
Meeting the criteria to undertake driving lessons – You must be at least 17 yrs of age, hold a valid provisional license and be entitled to drive in the UK. You must present your provisional licence to myself at the start of your first lesson. If you fail to do this, I have the right to cancel your lesson which will still be charged at the full rate. 
 
Covid-19 amendment – you must send me a photo of the front side of your driving license along with a check code from the website “view or share my driving license” so I can electronically check it on the DVSA database. This must be done no later than two days before your first lesson with me. This is due to the safety guidelines I must adhere to following the outbreak which states I cannot hold your driving license to check it. 
 
The car – I will provide a safe, maintained, modern manual car with dual controls. I have the appropriate driving instructors motor insurance and can present these documents if an accident was to occur during a lesson. The car has front and rear dash cam. This is primarily used for the safety of the car but I can also use the footage as a teaching aid. 
 
The Driving Instructor – I am a fully qualified GRADE A ADI. My ADI badge has to be legally on display in all lessons and you can locate mine on the top left side of the dashboard. I have to undertake regular Standards Check which are carried out and set by the DVSA. 
 
Booking lessons - I cannot guarantee set regular lessons however I will endeavour to provide lessons on days/ times that are suitable for you. My diary is set a month in advance. I send out all my available lesson times around the middle of the month for the following month to all my learners the lessons are then offered on a first come first serve basis. So, when you do get the list of available lesson, I strongly suggest you book your lessons asap to make sure you get the ideal lessons you would like. 
 
You can book as many lessons as you want at one time but I do advise you book at least one a week to make sure you progress with your learning.

I send out weekly reminders of up-and-coming lessons and payments that may be due. If you book a block booking, please note you must book and use all the lessons within that booking within a 3 months period. 
 
Lessons – Lessons run for two hours or longer durations that must be prearranged before the start of the lesson. The lessons will include an introduction, practical training, and a debrief. I will endeavour to provide the full two hours of lessons unless there are circumstances that are out of my control such as the safety of the car. I expect you to respect me as I would respect you, you are to follow my instructions especially when the concern of the Health and Safety for you, me and others around us are concerned. I will present myself and you’re teaching in a professional way, lessons will be structured around your style of driving and learning from the first lesson right through to your practical test. Pick up and drop off locations must be prearranged at least two days in advance of each lesson. If you fail to turn up to your lesson and I have tried to make contact with you without success within the first 10 minutes I will terminate the lesson and you will still be charged for it. 
 
Mobile phones – Both myself and you will not be allowed to use our mobile phones in a lesson unless in an emergency situation. You will be asked to put your phone on silent mode at the start of each lesson so that it cannot cause distraction during the lessons. 
 
Cancellation charges – Please note that I require a minimum notice of 48hrs if you wish to change or cancel a booked lesson. If the notice period is less than 48hrs you will be charged the full price for that said booked lesson. 
 
Please note I will endeavour to make sure I give as much notice as possible if I need to cancel / reschedule lessons. However please be aware that things can happen on a day-to-day basis that are out of my control such as issues with the car. If I do need to cancel a booked lesson, I will reschedule it at the earliest convenience and will also provide a selection of dates for you to choose from. 
 
Please note repeated cancellations will result in you being charged the following; two lesson in a row – no charge, three lessons in a row you will be charged half the price of a 2hr lesson (£43), cancel four in a row the charge will be for the full price of the lessons (£86) and cancel five in a row I reserve the right to terminate our agreement and will no longer provide driving lessons. 
 
Medical / health conditions - For me to provide the best learning opportunities for you please can you make me aware of any medical / health conditions that may have an effect in your lessons. This will be held strictly confidential. What is said in the car is between the two of us and no one else. But I do need to know especially with conditions such as asthma, diabetes, and anxiety so that I can act accordingly if an episode was to occur during a driving lesson. 
 
Prices– 
 
2hr lesson - £86 
10hr block - £410 
20hr block - £820 
 
I reserve the right to change prices at any time but will endeavour to provide appropriate notice to my learners. 
 
If price brackets change in a block booking, I will honour the original price until that block booking has been completed. 
 
Payments - I accept bank transfers or in car card payments. Please note in car card payments are for over £100 only so if you pay as you go this option will not be available. Please note that first payment is required upon booking. If booking one lesson then the full amount of £86 is required, if paying for a block booking then half is due upon booking for example a block of 10 hours is £410, £205 must be paid for upon booking, the remaining amount of £205 is due a week before the first lesson. Then moving forwards all future payments MUST be made in advance of lessons, if paying via bank transfer the payment is due two working days in advance. If paying via card payment this transaction MUST take place before we start the lesson. 
 
I withhold the right to terminate a lesson if payment has not been received by the start of the lesson and/or a late charge will be added to the outstanding amount of £10 per day until the outstanding balance has been paid in full. 
 
If you have signed up for an intensive course half the total price is required upon booking the intensive course, (this is non-refundable) the other half is due one week before the start of the first lesson. 
 
Covid-19 amendment – No cash payments will be accepted at this current time. Please pay via a bank transfer in advance of lessons. 
 
Refunds – If you are entitled to a refund there is an admin charge of £40 which will be deducted off the total refund. Refunds can take up to 28 days to complete. If you have paid a block booking you have a right to a refund within the first 14 days from the date you paid for the block booking. After those 14 days you cannot get a refund for any hours not used if you decide to stop lessons with this school. Please note if you have paid for a block booking but haven’t booked or used those lessons within 3 months from the payment date you will not be entitled to a refund. 
 
Covid-19 amendment – During these uncertain times if you are entitled to a refund, I may not be able to stick to the current 28 days time-frame. I will endeavour to complete refunds as soon as financially possible. 
 
Booking the practical test – The decision as to when to book your practical test is a joint decision between myself and you. Upon booking your test it will be agreed that as we approach your test date if I feel you are not ready you will move the test to another date, this decision is based on a mock test being coopeted successfully. I do have the right to refuse to provide my car if I professionally feel you are not ready to take your test. I do have high standards and I will advise you as to how I evaluate your chances of passing. Please note that as well as paying for the test you will also be required to pay for the use of my time and car at the normal hourly rate of £43 per hour, on test days I book you in for three hours. This covers the test time as well as a lesson before the test. Before booking the test, please check with me my availability for the test as there will be certain times of the day, I will not be able to do due to working hours. 
 
Covid-19 amendment – Please be advised that DVSA have stated that due to the current situation with covid-19 and the high demand for tests no learner should book a test without the agreement of their instructor as DVSA say it could be a while before a second test could be booked if you were to fail your test so to reduce this, they only want you to go for your test if your instructor feels very strongly you have a very good chance of passing. 
 
Working hours – I work Monday to Friday 9-6.30pm. I will not run lessons or attend tests out of these hours. During the day I may not respond to phone calls / messages due to teaching however I will respond in the evening; my phone will be available until 9pm. 
 
I do take annual leave which will vary depending on my family needs. However, I do take two weeks over Christmas and New Year and will take time off at some point in the school summer holidays, as well as the occasional day’s leave here and there. All my learners are notified of my annual leave at least one month in advance. 
 
Data protection – I am registered with Information Commissioners Group, (ICO). The only personal details I will hold about you are your first name and phone number on my mobile phone. Your date of birth and provisional licence is recorded on your progress sheet which you are responsible for.  
 
Complaints – If you are unhappy about the way I conduct my lessons please address your concern with me first through written or verbal communication. If you are not happy that the situation has been resolved then you can speak to the customer service team. The customer service team have 10 working days to respond to your complaint. Please note that all correspondence regarding complaints will be kept on a digital file for a year. Contact details for my customer services are:
